Chapter 1: General Provisions
1.1 Purpose
This Disclaimer and Risk Disclosure Statement (the "Document") is provided by the PETMAX platform and its operators (the "Platform") to inform users of the risks, user responsibilities, legal liabilities, and Platform limitation-of-liability provisions associated with participating in PETMAX games, the token system, Card trading, and related services. This Document is binding. Before using Platform services, users must read and understand it in full.
1.2 Risk Overview
By participating in any product or service offered by this Platform, users acknowledge the following risks (including but not limited to):
- Digital asset price volatility
- Randomness of game outcomes
- Technical system and smart contract risks
- Platform maintenance or upgrade risks
- Network and third-party service risks
- Token unlock and liquidity risks
- Policy and legal/regulatory risks
- Force majeure events (such as natural disasters, communication outages, and hacking attacks)
- Psychological sunk-cost and behavioral risks
- Multi-account, proxy-holding, and group-purchase risks
- Operational errors and improper account management
The Platform does not promise any fixed returns or investment outcomes. Before participating in any activity or committing any funds, users should fully understand the risks above and independently assess the amount of capital to commit and their risk tolerance. Games on this Platform do not constitute gambling or betting; outcomes do not result in the gain or loss of fiat currency.
1.3 Legal Nature
This Document does not constitute investment advice, a financial product description, or a guarantee of returns, nor does it constitute a contract, agreement, or commitment. Services provided by the Platform are intended solely for digital entertainment and digital-asset gaming purposes. Users must independently determine the legality of their conduct and their risk tolerance. Users bear all economic consequences arising from game participation or Card operations.
The Platform expressly states that users may not, for any reason, characterize their participation as investment, wealth management, stable returns, or guaranteed income. Rewards and yields provided by the Platform are probabilistic and for entertainment reference only; actual value may fluctuate with market conditions, user actions, or system status. Different countries and regions impose different legal and regulatory requirements on digital assets, NFTs, and in-game rewards. Users must independently confirm that participation is lawful in their jurisdiction.
1.4 User Acknowledgment Requirement
When first entering the PETMAX system, users must check a box confirming that they have read and understood this Disclaimer and Risk Disclosure Statement in full. Users who do not check the box cannot access games, tokens, or Membership Services. Checking the box constitutes:
- Voluntary assumption of all participation risks
- Full understanding of Platform operation instructions, yield descriptions, and related risks
- Agreement to the Platform's limitation-of-liability provisions to the extent permitted by law
Chapter 2: Definitions
2.1 Platform
"Platform" means PETMAX and its operators, official team, technical team, and affiliated service providers, including but not limited to personnel responsible for system development, maintenance, and customer support. The Platform provides technical support, service assurance, and operational maintenance but does not guarantee complete elimination of risk or fixed returns.
2.2 User
"User" means any individual or legal entity that registers, logs in, purchases, or uses games, tokens, Cards, and related services provided by the Platform. Users must have full legal capacity to enter into binding obligations. Users with limited capacity or minors must operate under guardian supervision. Users must keep account and wallet information secure; any loss caused by private key disclosure, account operation errors, or non-compliant conduct is borne by the user.
2.3 Cards
"Cards" means NFTs, virtual Cards, or other digital entitlement instruments issued within the PETMAX game system, used to participate in games, auto-play, or redeem in-system virtual rewards.
- Cards are non-refundable, non-divisible, and non-transferable
- When users operate with Cards, all yields, Gas fees, and system processing results are probabilistic or for reference only
- Users must independently assess Card usage and committed amounts; the Platform does not guarantee that yields exceed costs
After purchase, users may not demand return of tokens, Cards, or amounts paid.
2.4 Tokens
"Tokens" means digital assets issued or supported by the Platform, including but not limited to PEX and on-chain assets recognized by the Platform. Tokens may be used for in-game consumption, trading, or redemption, but their market value may fluctuate.
- Market prices may fluctuate significantly due to policy, supply and demand, liquidity, or other external factors
- Users bear the risk of token price declines or failed redemption
2.5 Game Yields
"Yields" means token rewards or equivalent value generated when users participate in PETMAX games, auto-play, re-investment, or Card usage, without guarantee of actual cash-equivalent value.
- Yield calculations provided by the Platform are for reference only
- Users may not rely on historical performance, theoretical calculations, or others' experience as guarantees of return
2.6 Membership Services
"Membership Services" means paid services provided by the Platform, such as daily, weekly, monthly, or quarterly passes, used to reduce transaction fees, Gas fees, or provide auto-play convenience. Membership Services are bound to a wallet address and are non-transferable and non-refundable.
- Each account and wallet address may correspond to only one Membership Service
- Unused remaining value of Membership Services after purchase is non-transferable and non-refundable
Chapter 3: Risk Disclosure
3.1 Digital Asset Price Volatility
- PEX or other tokens may fluctuate significantly; principal and yields may be lost in full
- Market prices may change materially due to policy adjustments, exchange liquidity, hacking, market manipulation, economic fluctuations, and other factors
- Users must assess their own risk tolerance and allocate funds rationally
3.2 Randomness and Probability of Game Outcomes
- PETMAX game outcomes are random; any operation may produce uncertain win/loss results
- The Platform does not guarantee win rates or yield levels
- High-frequency play, auto-play, and re-investment may lead to psychological sunk-cost accumulation
- Users should reasonably control operation frequency and committed amounts
- Games on this Platform do not constitute gambling or betting; outcomes do not result in the gain or loss of fiat currency
3.3 Technology and System Risks
- Smart contracts may contain vulnerabilities or be subject to malicious attacks, causing abnormal fund flows or loss of yields
- System maintenance, upgrades, or network congestion may cause transaction delays, failures, or delayed yield distribution
- Server failures, on-chain node anomalies, or third-party service interruptions may affect user operations and yields
- Users should fully understand technology and system risks; the Platform is not liable for any direct or indirect losses arising therefrom
3.4 Token Unlock and Liquidity Risks
- Tokens may unlock in phases; users may be unable to trade or withdraw freely during lock periods
- Insufficient market liquidity may prevent timely liquidation or cause abnormal price volatility
- Users bear token unlock and liquidity risks independently
3.5 Legal and Regulatory Risks
- Users must ensure conduct complies with applicable laws and regulations and must not engage in money laundering, fraud, or illegal transactions
- Consequences of user violations of law are borne by the user
- The Platform is not responsible for user non-compliance
Chapter 4: Digital Entertainment Assets and Psychological Risks
4.1 Entertainment Nature
The PETMAX platform and its games, Cards, and token system are positioned as digital entertainment asset products. During use, users may experience yield volatility and unpredictable outcomes, but no fixed returns are guaranteed. All yields are probabilistic references only; the Platform does not promise or guarantee investment returns. Users may not treat participation as investment, wealth management, or stable-income activity.
Games on this Platform do not constitute gambling or betting; outcomes do not result in the gain or loss of fiat currency. Different countries and regions impose different legal and regulatory requirements on digital assets, NFTs, and in-game rewards. Users must independently confirm that participation is lawful in their jurisdiction.
4.2 Psychological and Sunk-Cost Risks
High-frequency operations, auto-play, and re-investment may accumulate sunk-cost psychology and increase the desire to commit more funds. Users may experience anxiety, impulsive spending, or overspending due to yield volatility. The Platform recommends participating within a defined budget and arranging daily operation time reasonably. Users should assess their psychological tolerance to avoid irrational behavior caused by continuous operation.
4.3 Persons Who Should Not Participate
Minors, persons with mental health conditions, and users with unstable financial circumstances are not suitable participants. The Platform strongly recommends assessing financial condition and risk tolerance before participating. If a user is a minor or has limited legal capacity, all operations and consequences are borne by the guardian or the user.
4.4 Voluntary Participation
Entering the system constitutes voluntary assumption of risk. Users may not hold the Platform liable for losses caused by operation outcomes, psychological factors, or asset volatility for any reason.
Chapter 5: User Responsibilities and Obligations
5.1 Account and Wallet Management
Each account may bind only one wallet address; Membership Services and Cards are bound to that address. Users must properly safeguard wallet private keys, seed phrases, and account login credentials; any fund loss caused by improper custody is borne by the user. Multi-account use, proxy holding, group purchase, or pooled subscription behavior may result in account suspension, Membership Service invalidation, or cancellation of yields, with all consequences borne by the user.
5.2 Card and Membership Service Responsibilities
Once sold, Cards are non-refundable, non-returnable, and non-revocable; users bear purchase and usage costs independently. Membership Services are bound to wallet addresses and may not be transferred or split. Unused Membership Service value or remaining Card value is non-transferable, and the Platform has no compensation obligation. After purchase, users may not demand return of tokens, Cards, or amounts paid.
5.3 Conduct Standards
Users may not obtain improper yields through malicious operation, automated cheating, or other non-compliant means. The Platform may monitor abnormal operations in real time; violations may result in account suspension, yield cancellation, or permanent freezing. Users must comply with Platform rules, community standards, and applicable laws and regulations.
5.4 Capital Commitment and Yield Responsibility
Users independently decide committed amounts and operation frequency; the Platform does not advise on commitment size. Users understand that yields are for reference only and actual yields may be higher or lower than expected. Economic loss or psychological pressure caused by committing funds beyond one's capacity is borne by the user.
Chapter 6: Limitation of Platform Liability
6.1 Market and Price Volatility
The Platform is not responsible for PEX or other token price fluctuations, including price declines, insufficient liquidity, or failed transactions. Users should understand that market prices may fluctuate significantly and committed funds may be lost in full.
6.2 Technology and System Risks
The Platform does not guarantee uninterrupted, delay-free, or fault-free service. The Platform is not liable for losses caused by network congestion, node failures, server upgrades, or third-party wallet/exchange failures.
6.3 Yield Calculation and Payment Limits
Yield calculations provided by the Platform are for reference only; final distributed amounts may differ due to technical delays or system maintenance. To the extent permitted by law, Platform liability is capped at amounts actually paid by the user. Users may not hold the Platform liable for yield discrepancies or delayed distribution.
6.4 Force Majeure
The Platform is not liable for losses caused by natural disasters, policy changes, hacking attacks, system failures, war, epidemics, or communication outages. Users understand and accept force majeure risk and should independently assess the safety of participation and the scale of committed funds.
Chapter 7: Technology and Smart Contract Risks
7.1 Smart Contract Risks
Auto-play, re-investment, and Card features on the PETMAX platform rely on smart contract execution. Smart contracts may contain vulnerabilities or defects or be subject to malicious attacks, causing abnormal funds or yields. Users understand that smart contract operations are irreversible; once a transaction is executed or tokens are committed, they cannot be withdrawn. The Platform will endeavor to audit and maintain smart contracts but does not guarantee zero risk. Users bear all losses caused by smart contract issues, including but not limited to fund loss, yield deviation, and system anomalies.
7.2 System Maintenance and Update Risks
The Platform may periodically upgrade, maintain, or optimize systems, which may cause transaction delays, service interruptions, or abnormal yield calculations. The Platform is not liable for any loss or reduced yields from user operations during maintenance or upgrades. Users should follow Platform announcements and operation notices and adjust game strategy independently.
7.3 Network and Third-Party Service Risks
Games and transactions depend on the internet, blockchain nodes, and third-party service providers (such as wallets, exchanges, and blockchain explorers). Network delays, node failures, or third-party service interruptions may cause failed transactions, delayed yield distribution, or abnormal information display. The Platform is not liable for losses caused by third-party service issues.
7.4 Data and Account Security Risks
Users must properly safeguard wallet private keys, seed phrases, and account information to prevent account theft, abnormal operations, or asset loss. Fund losses caused by account theft or information disclosure are borne by the user. The Platform is not liable for asset loss caused by improper user custody.
Chapter 8: Token and Yield Risks
8.1 Token Unlock and Release Risks
Platform tokens may be subject to phased unlock or lock-up mechanisms; users may be unable to trade or withdraw freely during lock periods. Market prices may fall sharply when tokens unlock, reducing the value of committed funds. Users understand that token unlock does not equal immediately realizable yield; users bear the risk independently.
8.2 Market Liquidity Risks
Users may be unable to sell tokens at desired prices due to insufficient market supply and demand. Insufficient liquidity may cause abnormal price volatility or inability to realize value. The Platform is not liable for any loss caused by market liquidity issues.
8.3 Yield Calculation Reference
Yields provided by the Platform are estimated or theoretical values; actual yields may be higher or lower than estimates due to probability, game outcomes, auto-play conditions, Gas fees, or market volatility. Users may not demand compensation from the Platform based on estimated yields.
8.4 Re-Investment and Automated Operation Risks
Automatic re-investment or auto-play may be affected by system delays, blockchain network congestion, node anomalies, or unforeseen events. Users understand that re-investment and auto-play may cause temporary fund freezing, yield deviation, or unexpected loss. The Platform is not liable for yield volatility or fund loss caused by automated operations.
Chapter 9: Legal and Regulatory Risks
9.1 Applicable Law and Compliance
Users must ensure that their conduct complies with laws and regulations in their country or region, including rules on digital asset trading and financial regulation. Consequences of user violations are borne by the user; the Platform is not responsible.
9.2 Anti-Money Laundering and Tax Obligations
Users must comply with applicable anti-money laundering and counter-terrorist financing laws. Users must independently report tax obligations arising from digital asset trading or game yields. The Platform is not responsible for user failure to report or pay taxes.
9.3 Dispute Resolution
Disputes arising from use of Platform services should first be resolved through good-faith negotiation. If negotiation fails, disputes may be submitted to a court or arbitration institution in the Platform's place of registration. The Platform may adjust dispute resolution methods as required by law without affecting users' lawful rights.
Chapter 10: Force Majeure
10.1 Definition of Force Majeure Events
Force majeure means events beyond the reasonable control of both parties, including but not limited to natural disasters (earthquakes, floods, storms, fires, etc.), war, civil unrest, epidemics, energy or communication outages, blockchain attacks, regulatory policy changes, or other unexpected events. Users understand that force majeure may cause Platform service interruption, failed transactions, asset loss, reduced yields, or operation delays.
10.2 Force Majeure Exemption
The Platform is not liable for Platform service interruption, failed transactions, fund loss, or reduced yields caused by force majeure. Users should independently assess risks that force majeure may bring and arrange participation and committed funds accordingly. By participating, users understand and accept force majeure risk voluntarily.
10.3 Force Majeure Notice and Handling
The Platform will, where reasonably practicable, notify users of force majeure events and their scope through announcements, email, or in-system messages. Users understand that force majeure notices may be delayed; the Platform is not liable for delayed notice. Transaction or yield losses during force majeure events are borne by users.
Chapter 11: Multi-Account and Group-Purchase Risks
11.1 Single-Account Binding Rules
Each Membership Service, Card, and yield is bound to one wallet address, and each wallet address may correspond to only one account. Users may not use multiple accounts, proxy accounts, or others' accounts to obtain yields repeatedly or extend Membership Service benefits. The Platform may monitor, freeze, or cancel related yields for abnormal account behavior.
11.2 Group-Purchase and Pooled Subscription Risks
User-organized multi-person group purchases or pooled subscriptions for Membership Services do not affect the Platform's management of account yields and services. Funds, yields, disputes, or conflicts arising from group purchases are borne by participants; the Platform bears no responsibility. The Platform is not responsible for yield allocation or fund flows caused by any non-official operations.
11.3 User Conduct Restrictions
Users may not circumvent account binding rules in any form, such as sharing wallets, private keys, or account information. Violations may result in account suspension, Membership Service invalidation, yield cancellation, and other measures. Users commit to complying with Platform rules and bearing all consequences of violations.
Chapter 12: Advanced Auto-Play and Gas Fee Notice
12.1 Auto-Play Function Risks
When users choose automatic auto-play, they must pay related Gas fees in a lump sum. Gas fees are calculated based on the number of Cards held and estimated system consumption; actual consumption may differ slightly from estimates. Users understand that yields during auto-play are random and unpredictable. If delays, network congestion, node anomalies, or technical failures occur during auto-play, yield deviation or fund loss may result.
12.2 Gas Fees and Yield Ratio
The Platform offers Gas fee reduction services through purchase of daily, weekly, monthly, or quarterly passes, limited to the bound wallet address. If users exceed preset auto-play frequency or duration, additional Gas fees may be required. Users should independently assess committed amounts, Gas fees, and expected yield ratios; the Platform does not guarantee that yields exceed Gas expenditure.
12.3 Automated Operation Disclaimer
Auto-play, re-investment, and automated operations may be affected by blockchain network delays, node congestion, or system maintenance. The Platform is not liable for yield volatility or fund loss caused by automated operations. Users should clearly understand auto-play and re-investment risks and enable related features only on a voluntary basis.
12.4 High-Frequency Operation Risk Notice
High-frequency auto-play or re-investment may accumulate sunk-cost psychology and increase the desire to commit more funds. Users should monitor their psychological state and avoid excessive anxiety, impulsive spending, or overspending caused by yield volatility or unmet expectations.
Chapter 13: Term Updates and User Confirmation
13.1 Right to Update Terms
The Platform reserves the right to modify or update this Disclaimer and Risk Disclosure Statement at any time. Revised terms will be published through Platform announcements or system pages and take effect immediately. Continued use of services constitutes acceptance of updated terms.
13.2 User Confirmation Mechanism
When first entering the PETMAX game system, users must check a box confirming that they have read and understood this Disclaimer and Risk Disclosure Statement in full. When subsequent versions are updated, users must confirm acceptance again or they cannot continue using games and Membership Services. Checking the box constitutes voluntary acceptance, full understanding of risks, and agreement to all terms.
13.3 Severability
If any provision of this Document is held invalid or unenforceable, the validity of other provisions is unaffected. Each provision takes effect independently; risk assumption, limitation-of-liability provisions, and user responsibilities are not diminished because part of this Document is invalid.
Chapter 14: Appendix — Comprehensive Risk List
14.1 Risk Categories (Including but Not Limited To)
Digital Asset Price Volatility
PEX and other Platform-recognized tokens may experience significant price volatility. Supply and demand, policy adjustments, exchange liquidity, hacking, market manipulation, and other factors may reduce token value. User investments and yields may be lost in whole or in part. Games on this Platform do not constitute gambling or betting; outcomes do not result in the gain or loss of fiat currency.
Randomness of Game Outcomes
PETMAX game outcomes are random and probabilistic; win rates or yields cannot be guaranteed. Users may incur losses due to consecutive losses or low win rates.
High-Frequency Auto-Play and Sunk-Cost Risks
High-frequency auto-play or re-investment may accumulate sunk costs. Users may increase committed funds due to psychological expectations or prior investment.
Gas Fee Overspending Risk
High-frequency auto-play or Card operations may generate Gas fees exceeding budget. Users should independently assess the ratio of commitment to fees; the Platform does not guarantee yields exceed costs.
Technical Vulnerabilities and Smart Contract Risks
Smart contracts may contain vulnerabilities or defects, causing abnormal funds or yields. Operations are irreversible; once a transaction is executed or tokens are committed, they cannot be withdrawn.
System Maintenance, Upgrade, and Network Delay Risks
Periodic Platform upgrades or maintenance may cause transaction delays, abnormal yields, or failed operations. Network congestion or node anomalies may affect transactions and yield distribution.
Third-Party Service Interruption Risks
Third-party services such as exchanges, wallets, blockchain nodes, and explorers may be interrupted or delayed. Users bear yield anomalies or fund losses caused thereby.
Multi-Account, Group-Purchase, and Proxy-Holding Risks
Users may not obtain yields repeatedly through multiple accounts or proxy holding. Disputes and fund risks from group purchases, pooled subscriptions, or private collaboration are borne by users.
Legal, Regulatory, and Policy Change Risks
Policies and regulations in various jurisdictions may change at any time, affecting token trading, game conduct, and Membership Services. Users must independently determine legality of their conduct; the Platform does not bear legal risk.
Anti-Money Laundering and Tax Responsibility Risks
Users must comply with applicable anti-money laundering and tax laws. Tax obligations arising from digital asset trading or game yields must be reported and paid by users independently.
Minors and Limited Legal Capacity Risks
Minors, persons with mental health conditions, and users with limited legal capacity are not suitable participants. Users and guardians bear possible economic and legal consequences.
Psychological Dependence, Emotional Volatility, and Loss-of-Control Risks
High-frequency play and re-investment may cause emotional volatility, loss of control, or impulsive spending. Users should clarify their tolerance and arrange commitment and operation frequency reasonably.
Force Majeure Event Risks
Including but not limited to natural disasters, war, hacking, policy changes, epidemics, and system failures. Users understand that force majeure may cause asset loss and abnormal yields; the Platform is exempt from liability.
Insufficient Market Liquidity Risks
Users may be unable to sell or redeem tokens at expected prices due to insufficient supply and demand. Insufficient liquidity may cause abnormal price volatility or inability to realize value.
Token Unlock and Lock-Up Risks
Tokens may unlock in phases or be subject to lock-up; unlock timing and quantity are not fully controllable. Users cannot trade freely during lock periods and bear the risk independently.
Uncertainty of Rewards, Yields, or Distributions
Rewards, yields, or distributions provided by games or the Platform are reference values, not guaranteed returns. Users may not demand compensation from the Platform on that basis.
Social and Sharing Behavior Risks
Sharing and invitation behavior on the Platform or in communities may involve information disclosure, disputes, or conflicts. Related risks are borne by users.
Operational Errors and Improper Account Management Risks
Fund losses caused by user operational errors, account information disclosure, or lost private keys are borne by users.
Other Unknown Risks
Users acknowledge that participation in digital-asset entertainment may involve unforeseen new risks. Users should assess feasibility independently on an informed basis.
14.2 User Acknowledgment Statement
Users confirm that they fully understand all risks above and have self-assessed the acceptability of participation. Users commit not to dispute or demand compensation from the Platform under any circumstances due to these risks. Users clearly understand that participation in digital entertainment assets and the Card system may cause financial, time, and psychological loss.
Chapter 15: Final Confirmation
15.1 Full User Understanding and Acceptance
After checking the acknowledgment box, users are deemed to have read, fully understood, and voluntarily accepted the entire Disclaimer and Risk Disclosure Statement. Users understand that participating in PETMAX games and Membership Services may cause fund loss, yield volatility, and psychological risk, and voluntarily assume full responsibility.
15.2 Governing Law and Dispute Resolution
This Disclaimer and Risk Disclosure Statement applies to the extent permitted by law in the user's jurisdiction. Disputes arising from use of Platform services should first be resolved through good-faith negotiation. If negotiation fails, users agree to resolve disputes through applicable international arbitration institutions or courts with jurisdiction according to local law and the Platform service agreement. The Platform reserves the right to adjust dispute resolution methods as required by law and actual circumstances without affecting users' lawful rights. The Platform does not guarantee that user conduct complies with laws in all jurisdictions and provides risk notices only.
15.3 Version Priority
Electronic, announcement, and updated versions of this Document have equal legal effect. Continued use of Platform services after any version update constitutes agreement to the latest terms.
